Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using LogMySets ("we," "our," or "us") at www.logmysets.com (the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use LogMySets. By using the Service, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts found to belong to users under 18.

2. Your Account

When you register, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at contact@logmysets.com if you suspect any unauthorized access to your account.

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we believe you have violated these Terms or if your use of the Service poses a risk to us or other users. Upon termination, your right to access the Service ceases immediately.

3. Free Plan and Paid Subscriptions

LogMySets offers both a free plan and paid subscription tiers. The free plan provides access to core features at no charge. Paid subscriptions unlock additional features and are billed on a recurring basis (monthly or annually, as selected at checkout).

  • Billing: Payments are processed securely by Stripe, Inc. By providing your payment information, you authorize us to charge your chosen payment method on a recurring basis until you cancel.
  • Cancellation: You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods unless required by applicable law.
  • Price Changes: We may change subscription pricing at any time. We will give you at least 30 days' notice of any price increase before it takes effect on your account.

4. Acceptable Use

You agree to use LogMySets only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Upload or transmit any viruses, malware, or other harmful code

We reserve the right to investigate suspected violations and take appropriate action, including account suspension or termination and referral to law enforcement.

5. Your Data

All workout logs, personal records, and other data you enter into LogMySets ("Your Data") remain yours. Your Data is private by default and is not shared with other users. By using the Service, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

You are responsible for the accuracy of the data you enter. We do not verify the accuracy of workout data and are not liable for decisions you make based on information recorded in the Service.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, design, text, graphics, and logos — are the exclusive property of LogMySets and are protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

7. Health and Fitness Disclaimer

LogMySets is a tool for logging and tracking weightlifting sets. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any new exercise program, especially if you have any pre-existing medical conditions or injuries.

We are not responsible for any injury, harm, or adverse outcome that results from your use of information logged or tracked through the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, LogMySets and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage, arising out of or in connection with your use of or inability to use the Service.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Dispute Resolution

We encourage you to contact us first at contact@logmysets.com if you have a concern — most issues can be resolved quickly and informally.

  • Informal Resolution: Before initiating any formal proceeding, you agree to provide us with written notice of your dispute and allow 30 days for us to attempt to resolve it informally.
  • Arbitration: If a dispute cannot be resolved informally, you and LogMySets agree to submit the dispute to binding arbitration administered under the rules of the ADR Institute of Canada. The arbitration will be conducted in English. Each party will bear its own costs unless the arbitrator determines otherwise.
  • No Class Actions: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action.
  • Exceptions: Either party may seek emergency or injunctive relief from a court of competent jurisdiction without first going through arbitration.

11. Governing Law

These Terms and any disputes arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the courts located in Ontario, Canada for any matters not subject to arbitration.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top and notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account.

13. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and LogMySets regarding your use of the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
